Terms of Service

These Terms of Service govern your access to and use of EnsureDomains. EnsureDomains is an authorized reseller of GoDaddy products — including domain registration, web hosting, business email, SSL, website security, website builders, and marketing tools — which are provided and operated by GoDaddy, its ICANN-accredited registrar, the relevant registries, and other third-party providers. Please read these Terms carefully, including the sections describing our reseller role, the disclaimers, and the limitation of liability.

1. Agreement to these Terms

These Terms of Service ("Terms") form a binding legal agreement between you and EnsureDomains ("EnsureDomains", "we", "us", or "our") and govern your access to and use of our website, storefront, accounts, and the products and services we make available (collectively, the "Services").

EnsureDomains is an authorized reseller of GoDaddy products. We market and sell domain name registrations, web hosting, business email, SSL certificates, website security, website builders, marketing tools, and related products to end customers under our own brand. The underlying products are registered, hosted, processed, and operated by GoDaddy, its ICANN-accredited registrar, the relevant domain name registries, and other third-party providers — not by EnsureDomains. Our role and the resulting separation of responsibility are described in Section 3 and Section 12.

By accessing the Services, creating an Account, placing an Order, or purchasing or using any product offered through EnsureDomains, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Services.

Incorporation of third-party terms by reference

Because the products you purchase are provided by GoDaddy and other third parties, your use of those products is also subject to the applicable agreements and policies of those providers, which are incorporated into these Terms by reference. These include, without limitation, the GoDaddy and registrar Universal Terms of Service, domain registration agreements, hosting and email service agreements, acceptable use policies, the policies of the relevant domain name registry, and the policies of the Internet Corporation for Assigned Names and Numbers ("ICANN"), including the Registration Data, Transfer, Expired Registration Recovery, and Uniform Domain-Name Dispute-Resolution policies. Where there is a conflict between these Terms and a Third-Party Provider agreement with respect to a product that provider operates, the Third-Party Provider agreement controls for that product.

Eligibility to accept

You represent that you are at least 18 years of age or the age of majority in your jurisdiction, that you have the legal capacity and authority to enter into these Terms, and that, if you are accepting on behalf of a company or other legal entity, you are authorized to bind that entity. In that case, "you" refers to that entity.

2. Definitions

In these Terms, capitalized terms have the meanings set out below.

  • "Services" means the EnsureDomains website, storefront, customer accounts, support, and the products we resell and make available to you.
  • "Account" means the customer account you create or that is created for you to manage Orders, products, and billing through EnsureDomains.
  • "Order" means any request you submit to purchase, renew, transfer, upgrade, or modify a product through the EnsureDomains storefront.
  • "Reseller" means EnsureDomains in its capacity as an authorized reseller of GoDaddy products, acting as a storefront, billing facilitator, and front-line support provider.
  • "Registrar" means the ICANN-accredited domain name registrar (GoDaddy or its designated affiliate) that submits and maintains domain registrations on your behalf.
  • "Registry" means the organization that operates a top-level domain (for example, the operator of .com or .org) and sets the rules governing registrations within that top-level domain.
  • "Registrant" means the person or entity in whose name a domain name is registered. For domains you order, you are the Registrant.
  • "Third-Party Provider" means GoDaddy, the Registrar, the applicable Registry, payment processors, and any other third party that provides, operates, or supports a product made available through EnsureDomains.
  • "Content" means any data, text, files, code, images, domain configurations, DNS records, email, websites, or other material you upload, create, transmit, store, or display through the Services or any product.
  • "ICANN" means the Internet Corporation for Assigned Names and Numbers, the body that coordinates the domain name system and sets generic top-level domain policy.
  • "WHOIS" / "Registration Data" means the contact and registration information associated with a domain name, as required and governed by ICANN and Registry policy.
  • "UDRP" means ICANN’s Uniform Domain-Name Dispute-Resolution Policy and related procedures.

3. Our role as a reseller

This Section describes how EnsureDomains operates and is fundamental to your agreement with us. Please read it carefully.

EnsureDomains provides a branded storefront, account and Order management, billing facilitation, and front-line customer support. We facilitate your Orders and pass them through to GoDaddy, the ICANN-accredited Registrar, the relevant Registry, and other Third-Party Providers, who actually provide and operate the products you purchase.

The domain registrations, web hosting, business email, SSL certificates, website security, website builders, marketing tools, and any other products offered through EnsureDomains are provided, hosted, maintained, and operated by GoDaddy, the Registrar, the Registry, and other Third-Party Providers, under their own terms, infrastructure, and operational control.

We do not own or control the underlying infrastructure

We do not own, operate, host, or control the servers, networks, data centers, registries, registrar systems, payment infrastructure, or other facilities that deliver the products. We do not control and cannot guarantee the uptime, availability, performance, capacity, security, data integrity, or continued operation of those products or the infrastructure behind them.

Your use of any product is also governed by the applicable Third-Party Provider terms and policies (see Section 1 and Section 12). You are responsible for reviewing and complying with those terms. To the maximum extent permitted by applicable law, EnsureDomains is not responsible or liable for the acts, omissions, outages, suspensions, security incidents, data loss, domain loss, price changes, policy changes, or discontinuation of any Third-Party Provider or product, and your remedies in connection with those products may lie with the applicable Third-Party Provider rather than with EnsureDomains.

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and EnsureDomains, or between you and any Third-Party Provider, beyond the reseller relationship expressly described here.

4. Eligibility and your account

To use the Services and purchase products, you must be at least 18 years old or the age of majority in your jurisdiction and able to form a binding contract. You agree to use the Services only for lawful purposes and in compliance with these Terms and all applicable laws.

Accurate registration and contact information

ICANN and Registry policies require that the registrant and contact information associated with a domain name be accurate, complete, and current at all times. You agree to provide true, accurate, current, and complete information when you create an Account, place an Order, or register a domain, and to promptly update that information whenever it changes. Providing false or unreliable Registration Data, or failing to respond to inquiries about its accuracy within the required time, may result in the suspension or cancellation of a domain or other product by the Registrar or Registry.

Credentials and account security

You are responsible for safeguarding your Account credentials and for all activity that occurs under your Account, whether or not authorized by you. You agree to use strong, unique credentials, to keep them confidential, and to notify us immediately at support@ensuredomains.com if you suspect any unauthorized access to or use of your Account. We are not liable for any loss or damage arising from your failure to protect your credentials or from unauthorized use of your Account.

5. Orders, pricing, fees and currency

Prices for products are displayed on the EnsureDomains storefront and are shown in the currency you have configured or that is otherwise presented at checkout. Promotional or introductory prices may apply only to an initial term and may differ from standard or renewal prices.

Prices, fees, available products, and product features may change at any time, including as a result of changes by GoDaddy, the Registrar, the Registry, or other Third-Party Providers. We will apply the price in effect at the time your Order is processed. You are responsible for any applicable taxes, duties, levies, and fees associated with your Orders, except for taxes based on our net income.

Checkout and payment processing

Checkout and payment are processed through the secure GoDaddy-powered cart and payment processor and other Third-Party Provider payment systems. By placing an Order, you authorize us and the applicable payment processor to charge your selected payment method for the Order total, including applicable taxes and fees, and for any renewals you have not disabled (see Section 6). You represent that you are authorized to use the payment method you provide. We do not store full payment card details ourselves; payment data is handled by the Third-Party Provider payment processor under its terms and security practices.

If a charge is declined, reversed, or charged back, or if payment is otherwise not received, we and the relevant Third-Party Provider may suspend, cancel, or decline to renew the affected products, and you remain responsible for amounts owed.

6. Renewals and auto-renewal

Many products, including domain registrations, hosting, email, SSL, and security products, are configured to renew automatically at the end of each term unless auto-renewal is turned off before the renewal date. Auto-renewal helps prevent the unintended loss of a domain or service.

By purchasing a product, you authorize EnsureDomains and the applicable payment processor to automatically charge your payment method on file for the then-current renewal term, at the renewal price in effect at the time of renewal, until you turn off auto-renewal or cancel the product. Renewal prices may differ from, and are often higher than, introductory or initial-term prices.

Your responsibility to renew and stay current

You are responsible for keeping a valid payment method on file, for monitoring renewal dates, and for ensuring that domains and other products you wish to keep are renewed on time. If a product is not renewed — because auto-renewal was disabled, payment failed, or you cancelled — it may expire. Expiration of a domain can lead to loss of the domain, interruption of associated websites and email, and entry into Registry-governed grace, redemption, and deletion periods (see Section 8). To the maximum extent permitted by law, EnsureDomains is not responsible for any loss arising from a product’s expiration or non-renewal.

7. Refunds and cancellations

Refunds and cancellations are governed by the refund policies of the applicable Third-Party Provider, Registrar, and Registry for the specific product, and by any refund terms presented at the time of purchase. Because we pass Orders through to those providers, our ability to offer a refund depends on their policies.

  • Domain name registrations, renewals, transfers, redemption/restoration fees, and certain other products (such as SSL certificates and premium domains) are generally non-refundable once processed, because the corresponding fees are charged by the Registry and Registrar and cannot be reversed.
  • Some products may be eligible for a refund only within a limited window after purchase, as set by the Third-Party Provider; refunds outside that window are generally not available.
  • No refunds are provided for products terminated or suspended due to a violation of these Terms, the Acceptable Use Policy, or any Third-Party Provider, Registrar, Registry, or ICANN policy.

To cancel a product or turn off auto-renewal, use your Account controls where available or contact support@ensuredomains.com before the renewal date. Cancelling a product stops future renewals but does not, by itself, entitle you to a refund of amounts already paid except as required by the applicable refund policy or by law.

8. Domain name registration terms

Domain name registrations are subject to ICANN policies, the rules of the relevant Registry, and the agreement of the ICANN-accredited Registrar that processes the registration. By ordering a domain, you agree to those policies and rules in addition to these Terms.

You are the Registrant

For domains you order, you are the Registrant and are solely responsible for the domain name you select, including ensuring that your registration and use of the name does not infringe or violate the trademark, intellectual property, or other rights of any third party. You are responsible for conducting your own trademark and rights clearance before registering a name. EnsureDomains does not screen domain names for availability of rights and makes no representation that a name is free of third-party claims.

Accurate WHOIS / Registration Data

You must provide and maintain accurate, complete, and current Registration Data for each domain, as required by ICANN and the Registry. Failure to do so, or failure to respond to verification requests within the required period, may result in suspension or cancellation of the domain by the Registrar or Registry.

Expiration, grace, redemption, and deletion

If a domain is not renewed before it expires, it enters a sequence of Registry- and Registrar-governed periods that may include a renewal grace period, a redemption (restoration) period during which recovery is possible only on payment of additional fees, and ultimately deletion, after which the name may be released for registration by others. Timeframes and fees for these periods are set by the Registry and Registrar and are outside our control. We do not guarantee that an expired domain can be recovered.

Transfers and the 60-day lock

Domain transfers between registrars are governed by ICANN’s Transfer Policy and Registry rules. Among other requirements, a domain is generally subject to a 60-day inter-registrar transfer lock following an initial registration, a prior transfer, or certain changes to the registrant’s information, during which the domain cannot be transferred to another registrar. Additional authorization codes, unlock steps, and verification may be required to complete a transfer.

Privacy/proxy and dispute policies

Where available, you may enable a WHOIS privacy or proxy service offered by the Third-Party Provider, subject to its terms. Domain registrations are also subject to ICANN’s Uniform Domain-Name Dispute-Resolution Policy (UDRP) and any applicable Registry or rights-protection dispute procedures, under which a domain may be suspended, transferred, or cancelled as a result of a dispute. The Registrar or Registry may also suspend, lock, transfer, or cancel a domain to comply with ICANN or Registry policy, a legal or regulatory requirement, a dispute resolution decision, or to address fraud, abuse, or security risks.

We do not guarantee that any particular domain name is or will remain available, or that a registered domain will remain registered to you, where loss results from expiration, non-payment, policy enforcement, dispute resolution, or the acts or omissions of a Third-Party Provider, Registrar, or Registry.

9. Hosting and other services

Hosting, email, website builder, security, and similar products are provided and operated by the applicable Third-Party Provider and are subject to that provider’s service terms, resource limits, and acceptable use requirements, in addition to these Terms.

You agree to use these products within their designated resource limits and intended purpose, and not to consume resources in a manner that degrades service for others or circumvents provider limits. You are solely responsible for your Content, your site and service configuration, your application code and software, and your compliance with applicable laws and provider policies.

Backups are your responsibility

You are responsible for maintaining your own independent backups of your Content and data. Even where a Third-Party Provider offers backup features, you should not rely on them as your sole copy. To the maximum extent permitted by law, EnsureDomains is not responsible for any loss, corruption, or destruction of Content or data.

Availability and beta features

Uptime, availability, and performance of hosting and other products are determined and provided by the Third-Party Provider and are not guaranteed by EnsureDomains. Any uptime commitments, service levels, or remedies are those offered by the Third-Party Provider under its terms. Any beta, trial, preview, or early-access features are provided “as is” and may be changed or withdrawn at any time.

10. Acceptable Use Policy

You agree not to use, and not to allow others to use, the Services or any product to engage in prohibited content or conduct. The following are prohibited (in addition to any acceptable use rules imposed by a Third-Party Provider, Registrar, or Registry):

  • Illegal content or activity, or any use that violates applicable local, national, or international law or regulation.
  • Infringement or misappropriation of intellectual property, including copyright, trademark, patent, trade secret, publicity, or privacy rights.
  • Distribution of malware, viruses, ransomware, or other malicious code; phishing, spoofing, pharming, or fraudulent schemes.
  • Sending unsolicited bulk or commercial email (spam) or other forms of network or messaging abuse.
  • Child sexual abuse material (CSAM) or any content that sexually exploits or endangers minors. This is strictly prohibited and will be reported to the appropriate authorities and organizations as required by law.
  • Harassment, threats, stalking, hate speech, or incitement of violence against any person or group.
  • Network abuse, unauthorized access, port scanning, denial-of-service attacks, interference with or circumvention of security or authentication measures of any system or network.
  • Cryptocurrency mining or similar resource-intensive activity where prohibited by the applicable product terms or where it exceeds permitted resource use.
  • High-risk, regulated, or restricted uses (for example, certain financial, gambling, pharmaceutical, or export-controlled activities) carried out without the required licenses, authorizations, or compliance.
  • Circumventing, disabling, or interfering with usage limits, quotas, billing, or other technical or contractual restrictions of EnsureDomains or any Third-Party Provider.

Consequences. Violation of this Acceptable Use Policy may result in the immediate suspension or termination of the affected products or your Account, without refund, by EnsureDomains or by the applicable Third-Party Provider, Registrar, or Registry. We may also remove or disable access to offending Content and report unlawful activity to law enforcement and other authorities where required or appropriate.

11. Your content and responsibilities

You retain ownership of your Content, and you are solely responsible for it, including its legality, accuracy, and the consequences of hosting, transmitting, or publishing it. You represent that you have all rights necessary to use your Content with the Services and the products.

To enable us and the Third-Party Providers to operate the Services and deliver the products you order, you grant EnsureDomains and the applicable Third-Party Providers a limited, non-exclusive, worldwide license to host, store, transmit, cache, display, and process your Content solely as necessary to provide, maintain, secure, and support the Services and products. This license ends when the relevant Content is removed or the product is terminated, except to the extent the Content has been shared with others, must be retained for legal or backup purposes, or remains in routine system backups for a limited period.

You agree to comply with all applicable laws and with all Third-Party Provider, Registrar, Registry, and ICANN policies applicable to your use. You are responsible for compliance with applicable export control and economic sanctions laws, and you represent that you are not located in, and will not use the Services or products on behalf of any person located in, an embargoed or sanctioned jurisdiction, and that you are not a party with whom dealings are prohibited under such laws.

12. Third-Party Providers and products

The products available through EnsureDomains are provided by GoDaddy and other Third-Party Providers and are subject to their respective terms of service, acceptable use policies, and privacy policies. Your relationship with respect to the operation of those products is, in substance, with the Third-Party Provider that operates them.

To the maximum extent permitted by applicable law, EnsureDomains is not responsible or liable for, and makes no warranty regarding:

  • the acts, omissions, errors, or negligence of any Third-Party Provider, Registrar, or Registry;
  • outages, downtime, interruptions, degraded performance, maintenance, or unavailability of any product;
  • suspension, locking, cancellation, transfer, or termination of any product or domain by a Third-Party Provider, Registrar, or Registry;
  • loss, corruption, or unauthorized access to data, Content, email, websites, or domains;
  • changes to a Third-Party Provider’s prices, features, terms, or policies; or
  • the discontinuation or withdrawal of any product.

Your remedies in connection with the products provided by a Third-Party Provider may lie with that Third-Party Provider under its terms, and not with EnsureDomains. We will, where reasonable and within our role as Reseller, provide front-line support and help coordinate with the Third-Party Provider, but we do not assume the Third-Party Provider’s obligations.

13. Intellectual property

The EnsureDomains name, logos, brand, storefront, website design, text, graphics, and other materials we provide (excluding your Content and Third-Party Provider materials) are owned by or licensed to EnsureDomains and are protected by intellectual property and other laws. The “EnsureDomains” name and marks are our trademarks, and you may not use them without our prior written consent.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the EnsureDomains website and storefront for the purpose of browsing, purchasing, and managing products for your own use.

You may not copy, scrape, crawl, harvest, frame, mirror, reverse engineer, decompile, or attempt to derive the source code of any part of the Services, except to the extent such restriction is prohibited by applicable law. You may not use any automated means to access the Services in a manner that burdens our infrastructure or that of a Third-Party Provider, or that circumvents access controls or rate limits.

14. Disclaimers of warranties

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ENSUREDOMAINS, ON ITS OWN BEHALF AND ON BEHALF OF ITS AFFILIATES, LICENSORS, AND THIRD-PARTY PROVIDERS, DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, USAGE, OR TRADE PRACTICE.

Without limiting the foregoing, EnsureDomains does not warrant or guarantee that:

  • the Services or any product will be uninterrupted, timely, secure, error-free, or available at any particular time or location;
  • any defects or errors will be corrected, or that the Services or any product are free of viruses or other harmful components;
  • the results obtained from the use of the Services or any product will be accurate, reliable, or meet your requirements;
  • data, Content, email, websites, or domains will not be lost, corrupted, or subject to unauthorized access;
  • any domain name is or will remain available, or that a registered domain will remain registered to you; or
  • any Third-Party Provider, Registrar, or Registry will perform, remain available, maintain its prices or policies, or continue to offer any product.

EnsureDomains makes no warranty with respect to any Third-Party Provider or any product operated by a Third-Party Provider, and all such products are subject to the warranties (if any) offered by that provider under its own terms. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ENSUREDOMAINS OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS, OR ANTICIPATED SAVINGS, BUSINESS INTERRUPTION, OR THE COST OF SUBSTITUTE PRODUCTS OR SERVICES, ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PRODUCT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENSUREDOMAINS WILL HAVE NO LIABILITY FOR ANY DOMAIN LOSS, EXPIRATION, OR NON-RENEWAL; DOWNTIME, OUTAGE, OR UNAVAILABILITY; DATA LOSS OR CORRUPTION; SECURITY INCIDENT OR UNAUTHORIZED ACCESS; OR THE ACTS OR OMISSIONS OF ANY THIRD-PARTY PROVIDER, REGISTRAR, OR REGISTRY.

Liability cap

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF ENSUREDOMAINS ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PRODUCT, FOR ANY AND ALL CLAIMS, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU ACTUALLY PAID TO ENSUREDOMAINS FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.

These limitations and exclusions apply even if any remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you; in such cases, our liability is limited to the maximum extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless EnsureDomains and its affiliates, and their respective officers, directors, employees, agents, licensors, and partners (including, where applicable, the Third-Party Providers), from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  1. your Content or any material you upload, transmit, publish, or store through the Services or any product;
  2. your use of, or activity in connection with, the Services or any product;
  3. your breach or alleged breach of these Terms or of any Third-Party Provider, Registrar, Registry, or ICANN policy; or
  4. your violation of any applicable law or regulation or of any right of a third party, including any intellectual property, privacy, or publicity right.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of that claim. You may not settle any claim in a manner that imposes any obligation or admission on EnsureDomains without our prior written consent.

17. Suspension and termination

We may suspend or terminate your Account, an Order, or access to any product, in whole or in part, with or without notice, if: (a) you breach these Terms or the Acceptable Use Policy; (b) you fail to pay amounts when due, or a payment is reversed or charged back; (c) suspension or termination is required to comply with a legal, regulatory, ICANN, Registrar, or Registry requirement; or (d) we reasonably believe continued provision poses a security, fraud, abuse, or legal risk. A Third-Party Provider, Registrar, or Registry may also independently suspend, lock, cancel, or terminate a product or domain in accordance with its own terms or applicable policy.

Upon termination, your right to access and use the affected Services and products ceases. Termination may result in the deletion of Content and the loss of domains, websites, email, and data, and we are not responsible for any such loss to the maximum extent permitted by law. No refund will be provided where termination or suspension results from a breach of these Terms or applicable policy (termination for cause).

Provisions that by their nature should survive termination will survive, including the definitions, our reseller role and Third-Party Provider disclaimers, your content and responsibilities, intellectual property, disclaimers of warranties, limitation of liability, indemnification, governing law and dispute resolution, and the general provisions.

18. Changes to the Terms and the Services

We may modify these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, where appropriate, provide additional notice. Changes are effective when posted unless otherwise stated. Your continued access to or use of the Services after the changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services.

20. Force majeure

EnsureDomains will not be liable for any delay in or failure of performance arising out of causes beyond our reasonable control, including, without limitation, acts of God, natural disasters, fire, flood, severe weather, war, terrorism, civil unrest, labor disputes, governmental or regulatory action, changes in law, pandemic or epidemic, failures or outages of GoDaddy, the Registrar, the Registry, or other Third-Party Providers, internet, network, hosting, or telecommunications failures, power outages, cyberattacks, denial-of-service attacks, and other events outside our reasonable control. Our obligations are suspended for the duration of the event.

21. General provisions

  • Entire agreement. These Terms, together with any policies and Third-Party Provider agreements incorporated by reference, constitute the entire agreement between you and EnsureDomains regarding the Services and supersede all prior or contemporaneous understandings on that subject.
  • Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
  • No waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that or any other right or provision.
  • Assignment. We may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, reorganization, or sale of assets. You may not assign or transfer these Terms without our prior written consent, and any attempted assignment in violation of this provision is void.
  • Relationship of the parties. You and EnsureDomains are independent contractors. Nothing in these Terms creates any partnership, joint venture, agency, fiduciary, or employment relationship between the parties.

  • No third-party beneficiaries, except that the Third-Party Providers and our affiliates are intended beneficiaries of the disclaimers, limitations of liability, and indemnities that reference them.
